These Terms Of Use ("Terms") govern your access to and use of affpinions.com, including all pages, tools, directory listings, guides, newsletters and services (together, the "Site"). In these Terms, "Affpinions", "we", "us" and "our" refer to the operator of the Site, and "you" refers to any person who accesses or uses the Site.

Please read these Terms carefully. By using the Site you agree to them. If you do not agree, you must stop using the Site. Some parts of these Terms do not apply to you if you are a consumer and the law gives you rights that cannot be excluded.

1. About these Terms

1.1 These Terms set out what you can expect from us and what we expect from you. They should be read together with our Privacy Notice, Cookies Notice, Disclaimer & Affiliate Disclosure and Editorial Policy, which also apply to your use of the Site.

1.2 If you buy one of our paid services, additional service terms apply (see section 9). If there is a conflict between these Terms and a written agreement signed for a specific service, the written agreement prevails.

1.3 We may update these Terms from time to time, for example to reflect changes in law, technology or the services we offer. The "Last updated" date shows when they were last changed. Material changes will be highlighted on the Site. Continued use of the Site after changes take effect means you accept the updated Terms.

2. Who may use the Site

2.1 To use the Site you must be at least 18 years old and legally permitted to use it in the country where you are located.

2.2 Some listings relate to products or services that are age-restricted or regulated in certain countries, such as gambling, adult, finance or crypto. It is your responsibility to make sure that joining or promoting any program is lawful where you and your audience are located.

2.3 The Site is not intended for distribution to, or use by, any person in any jurisdiction where such distribution or use would be contrary to law. If you access the Site from outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

3. What Affpinions provides

3.1 Affpinions is a free discovery tool and information resource. It lists affiliate networks and programs, summarises key details such as payout thresholds, payment methods and commission types, and publishes educational guides and tools.

3.2 Affpinions is not an affiliate network and is not a party to any agreement between you and a network, program or merchant. Any relationship you enter into with a third party is solely between you and that third party, and is governed by their terms.

3.3 We do not guarantee that you will be accepted into any program, earn any particular amount, or be paid by any third party.

4. Listings data and accuracy

4.1 Listings are researched by hand using public sources, information supplied by networks and contributions from users. Affiliate terms change frequently and we cannot guarantee that every detail is complete, current or error-free at the moment you read it.

4.2 You must verify important information — including commission rates, payout thresholds, payment methods, cookie durations and traffic rules — directly with the network or program before relying on it.

4.3 If you find an error, please suggest an edit. We aim to review correction requests within five working days.

5. Acceptable use

You agree not to:

  • use the Site in any way that breaches any applicable law or regulation, or that is fraudulent or harmful;
  • scrape, crawl, harvest or systematically copy the directory database or substantial parts of the Site by automated means without our written permission, other than by search engines and AI services in accordance with our robots.txt for the purpose of indexing;
  • attempt to gain unauthorised access to the Site, its server or any connected system, or interfere with its operation (including by introducing viruses, malware or denial-of-service attacks);
  • submit false, misleading, defamatory or infringing information, including fake reviews or misrepresentations about networks;
  • impersonate any person or business, or misrepresent your affiliation with any network or program;
  • use the contact form or any other feature to send spam or unsolicited commercial messages;
  • frame or mirror the Site, or remove or alter any copyright or proprietary notices.

We may suspend or restrict your access to the Site if we reasonably believe you have breached this section.

6. Your submissions

6.1 When you submit information to us — for example a new listing, an edit suggestion, a message or a guest article proposal ("Submissions") — you confirm that it is accurate to the best of your knowledge, that you have the right to share it, and that it does not infringe anyone else's rights.

6.2 You grant Affpinions a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, edit, adapt and publish non-personal parts of your Submissions in connection with the Site. We will handle personal data in Submissions according to our Privacy Notice.

6.3 We are not obliged to publish any Submission and may edit Submissions for accuracy, clarity, length or legal reasons.

7. Intellectual property

7.1 Unless otherwise stated, the Site and its content — including text, the directory database, design, graphics, logos, software and the compilation of all content — are owned by or licensed to Affpinions and are protected by copyright, database rights, trade mark law and other intellectual property laws.

7.2 You may view, download and print pages for your own personal, non-commercial use. You may quote short extracts with a clear attribution and a link to the relevant page.

7.3 Third-party names, logos and trade marks shown on the Site belong to their respective owners and are used for identification purposes only. Their use does not imply endorsement.

7.4 Photographs used on the Site are licensed stock images or images supplied by their owners and remain the property of their respective rights holders.

8.1 The Site contains links to third-party websites, including affiliate networks and programs. Some links are affiliate links from which we may earn a commission — see our Disclaimer & Affiliate Disclosure.

8.2 We have no control over third-party websites and are not responsible for their content, availability, privacy practices or terms. Visiting them is at your own risk.

9. Paid services

9.1 Descriptions and prices of our services are shown on the Services page. Prices are shown in US dollars and exclude VAT or other sales taxes where applicable. Prices displayed in other currencies are indicative only.

9.2 A contract for a service is formed only when we confirm your order in writing (including by email) after agreeing the scope with you. We may decline any request.

9.3 One-off services are payable in advance unless agreed otherwise. Monthly services renew each month until cancelled; you can cancel at any time with effect from the end of the current billing month.

9.4 Our services provide research, analysis and recommendations. They do not constitute legal, tax or financial advice, and we do not guarantee any particular commercial outcome, ranking or income.

9.5 If you are a consumer in the UK or EU, you may have a statutory right to cancel a service contract within 14 days of it being formed. If you ask us to begin work within that period, you may have to pay for the work already done, and you lose the right to cancel once the service is fully performed.

9.6 A Verified Network Listing confirms that we have checked the listing data with the network. It does not buy a higher position, a positive review or editorial coverage. See our Editorial Policy.

10. Disclaimers

10.1 The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all warranties, conditions and representations, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose and non-infringement.

10.2 Content on the Site is for general information only. It is not professional advice and should not be relied on as such. Read our full Disclaimer.

10.3 We do not guarantee that the Site will always be available, uninterrupted, secure or free from bugs or viruses. You should use your own virus protection software.

11. Limitation of liability

11.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.

11.2 Subject to 11.1, if you use the Site as a business, we will not be liable for any loss of profits, sales, business, revenue or commissions; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss, arising out of or in connection with the Site or any third-party program.

11.3 Subject to 11.1, our total liability to you in connection with the free Site shall not exceed £100. For paid services, our total liability shall not exceed the fees you paid for the service in question in the 12 months before the claim arose.

11.4 If you are a consumer, we only provide the Site for domestic and private use, and we are not liable for any business losses.

12. Indemnity

If you use the Site in breach of these Terms or applicable law, you agree to indemnify us against reasonable losses, damages and costs (including reasonable legal fees) arising from that breach, to the extent permitted by law.

13. Suspension and termination

We may suspend, withdraw or change all or any part of the Site for business or operational reasons. We will try to give reasonable notice of any significant change. We may terminate your access immediately if you materially breach these Terms.

14. Privacy

We process personal data in accordance with UK data protection law. Details are in our Privacy Notice and Cookies Notice.

15. General

15.1 Entire agreement. These Terms, together with the policies referred to in them, are the entire agreement between you and us regarding the Site.

15.2 Severability. If any provision is found invalid or unenforceable, the remaining provisions remain in full force.

15.3 No waiver. If we delay enforcing these Terms, we can still enforce them later.

15.4 Transfer. We may transfer our rights and obligations under these Terms to another organisation. You may not transfer yours without our written consent.

15.5 Third-party rights. No one other than you and us has any right to enforce these Terms.

16. Governing law and disputes

16.1 These Terms are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings there, and if you are a consumer resident elsewhere you may benefit from mandatory provisions of the law of your country of residence.

16.2 If you have a complaint, please contact us first so we can try to resolve it informally.
